Terms of Sale

The French version of these Terms of Sale is the legally binding reference. This English translation is provided for convenience.
Article 1 — Purpose
These Terms of Sale (hereinafter the "Terms") govern the sale of digital visual artworks (downloadable files) by Terre Normande (hereinafter the "Seller") through the FrenchSeventhArt website (hereinafter the "Site") to any customer (hereinafter the "Customer").
Any order placed on the Site implies the Customer's unreserved acceptance of these Terms.

Article 3 — Products offered
The Site sells original stylised artworks, created with the assistance of artificial-intelligence tools, as downloadable digital files (hereinafter the "Artworks"). Each Artwork is sold as a bundle containing several ready-to-print formats (for example 2:3, 3:4, 4:5, 5:7, A4, A3), downloadable separately or as a single archive.
The Artworks are original compositions and are in no way reproductions of film posters, scenes or portraits of real actors.
Article 4 — Prices
Prices shown on the Site are in euros (€) inclusive of all taxes: the applicable VAT is included in the displayed price and itemised on the invoice; no amount is added at checkout. An invoice is issued for every paid order and remains downloadable from the "My orders" area. The Seller reserves the right to change its prices at any time, it being understood that the applicable price is the one in force when the order is confirmed.
Article 5 — Order and payment
The order is finalised when the Customer confirms payment through the secure Polar platform. The Seller neither collects nor stores any banking data: it is processed directly by Polar, which also acts as the party responsible for collecting and remitting the applicable VAT.
A Customer account (email and password) is required to place an order and to access the purchase history and downloads.
Article 6 — Delivery
As the Artworks are digital files, delivery is immediate: as soon as payment is confirmed, the files become available for download in the Customer's "My orders" area and on the order confirmation page.
Article 7 — Right of withdrawal
In accordance with article L221-28 13° of the French Consumer Code, the right of withdrawal cannot be exercised for the supply of digital content not provided on a tangible medium where performance has begun after the Customer's express prior consent and express waiver of the right of withdrawal.
By ticking the consent box at checkout, the Customer acknowledges that they request immediate performance (immediate download) and expressly waive their 14-day right of withdrawal as soon as the file is downloadable.
Article 8 — Intellectual property and right of use
The purchase of an Artwork grants the Customer a personal, non-exclusive and non-transferable right of use: printing for private use, personal decoration, gift. The Customer may not resell, redistribute, sub-licence, modify or commercially exploit the purchased files without the Seller's prior written authorisation. The permitted and prohibited uses are detailed in the Personal use licence, accepted at the time of the order and included with every download; any commercial use is subject to a specific licence (requests: support@frenchseventhart.com).
The Seller retains all intellectual property rights attached to the Artworks.
Article 9 — Liability
The Seller cannot be held liable for damage resulting from misuse of the files by the Customer (poor print resolution, wrong choice of format, etc.). It is the Customer's responsibility to check the file's compatibility with their printer before printing.
Article 10 — Personal data
The data collected (email, encrypted password, order history) is used solely to manage the Customer account and orders. It is neither sold nor shared with third parties for commercial purposes; only the Site's technical providers (Polar for payment, Resend for emails, Hostinger International Limited for hosting) access it, solely for their task — see the legal notice. In accordance with the GDPR, the Customer has a right to access, rectify and erase their data, by writing to support@frenchseventhart.com.
Article 11 — Disputes and applicable law
These Terms are governed by French law. In the event of a dispute, an amicable solution will be sought before any legal action. Failing an amicable agreement, the competent French courts shall have sole jurisdiction, subject to any mandatory legal provision to the contrary applicable to consumers.
